THIS DEED is executed at…………….on this…………….day of……………20……… between A son of Shri…………….resident of…………………hereinafter called the “Grantor”, (which expression shall unless it be repugnant to the context or meaning thereof include his heirs, assigns and executors) of the ONE PART and B son of Shri…………………resident of…………….hereinafter called the “Grantee” (which expression shall unless it be repugnant to the context or meaning thereof include his heirs, assigns and executors) of the OTHER PART
WHEREAS
(1)The grantor is the owner of the land situate at…………….and delineated on the map annexed hereto and thereon colored pink;
(2) The grantee is owner of the land situated at…………….and delineated on the said map hereto and thereon colored green.
(3) The grantor has constructed a sewer beneath the surface of the said piece of land colored pink and is connected with the main sewer marked at the point marked X on the said map, the course of which sewer is shown on the said map by dotted lines between the point marked X and Y thereon.
(4) At the request of the grantee, the grantor has agreed in to grant consideration of the payment of the sum of Rs . ………to grantee such rights in respect of the said sewer as are hereinafter described.
NOW THIS DEED WITNESSETH AS FOLLOWS:
In pursuance to the said agreement and in consideration of the payment of the sum of Rs …………….by the grantee to the grantor(the receipt whereof the latter hereby acknowledges), the grantor as beneficial owner hereby grants unto the grantee
Firstly, full rights and liberty to use with the grantor the said sewer for the passage or conveyance of sewage water and soil from the said piece of land color green on the said map.
Secondly, full rights and liberty for the aforesaid purpose but not for any other purpose to make forever hereafter to repair and maintain all such connections with the said sewer at the point marked X on the said map as may be necessary at his own expenses
Thirdly, full rights and liberty to enter upon the said piece of land color pink for the purpose of making, repairing and maintaining such connections as aforesaid, but not for any other purpose
TO HOLD all the said rights and liberties hereby granted unto the grantee
